1. Acceptance of Terms
By accessing and using MicXchange ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Platform.
2. Description of Service
MicXchange provides a digital media platform enabling creators to publish, distribute, monetize, and license content including music, podcasts, video, photography, and digital products. The Platform also provides radio broadcasting, event hosting, and commerce services.
3. User Accounts
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 13 years old to use the Platform.
4. Creator Content
Creators retain ownership of their content. By publishing on MicXchange, you grant the Platform a license to host, display, distribute, and process your content as necessary to provide the services. You represent that you have all necessary rights to your content.
5. Revenue Sharing
Creators get paid up to 95% on eligible revenue. Specific payout terms may vary based on membership tier and transaction type. Payouts are processed according to the PayoutPolicy in effect at the time of transaction.
6. Prohibited Conduct
You may not use the Platform to upload infringing content, engage in fraud, harass others, distribute malware, or violate any applicable law. The Platform reserves the right to suspend or terminate accounts that violate these Terms.
6a. Advertising
The Platform displays advertisements, including ads served by Google AdSense and other third-party advertising partners. Ads may be personalized based on your activity across MicXchange and other websites, subject to your consent choices and applicable law. Advertisers are solely responsible for the content of their advertisements. MicXchange is not responsible for the products or services advertised. Users may manage advertising preferences through the cookie consent banner and Google Ads Settings. Revenue from advertising supports the Platform and its creators.
7. Intellectual Property
All Platform software, design, branding, and non-user content is owned by MicXchange. User content is owned by the respective creators. Licensing of user content is governed by the Licensing Terms.
8. Termination
You may close your account at any time. The Platform may suspend or terminate accounts that violate these Terms. Upon termination, your content may be removed from the Platform.
9. Disclaimer of Warranties
The Platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.
10. Limitation of Liability
MicXchange shall not be liable for indirect, incidental, or consequential damages arising from your use of the Platform.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
